Participation Agreement
Participation in Bright Horizons Backup Care (the “programme”) and use of its services are contingent on your full compliance with Bright Horizons’ User Guide. You may review our User Guide in detail by clicking on the link at the bottom of the home page upon logging in. You may not solicit or employ any programme caregivers for similar services within one (1) year of the date of your last programme use without Bright Horizons’ written permission and additional restrictions and fees may apply if required by a caregiver’s employer. Bright Horizons reserves the right to decline to provide services to a family who demonstrates behavior that is inappropriate, abusive, disrespectful or threatening to others, who is disruptive to our operations, or who refuses to comply with our policies or procedures. For care provided in a home or other approved location, the family is expected to provide a clean, healthy and safe environment for both care recipient(s) and the caregiver. Privacy Notice BH processes personal data under the programme which includes but is not limited to name; address; telephone contacts; date of birth; email addresses; authorised and medical contacts; employment information if relevant; gender; physical conditions; disabilities or allergies; dietary requirements; and care, learning and development records, which include child photographs (Personal Data). BH processes Personal Data under the programme for the following purposes: (1) ensure a safe, healthy and successful environment for your child; (2) administer medical care when necessary; (3) comply with government regulations and Centre policies and procedures; (4) aide in the administration of services; (5) allow your employer to assess utilisation and quality of services information; (6) staff training and development; and (7) internal market research. BH may share Personal Data processed under programme under the following circumstances: (1) if a caregiver suspects child abuse and/or neglect, it will report these concerns to the relevant authorities in accordance with its policies and procedures and regulatory requirements; (3) share utilisation and standard of care information with your employer; (4) with any other setting your child attends or may attend as required by regulation; (5) third party processors that are subject to confidential non-disclosure agreements; and/or (6) as required by Court Order, law or regulation. BH transfers Personal Data outside the European Economic Area subject to the requirements of data privacy laws.
